Probate can seem daunting to many. Could you walk our viewers through one of the key steps in the process?

Steve Bliss:

Certainly. One crucial step is handling debts and taxes, which typically occurs after the estate assets have been marshalled.

This stage involves diligently identifying and paying all valid creditor claims against the deceased’s estate. Creditors might include banks, utility companies, medical providers, or anyone else the individual owed money to. It’s important to note that only debts incurred by the deceased are considered; personal debts of surviving family members are not part of probate.

Consequently, it requires careful scrutiny of financial records and communication with potential creditors. Ordinarily, a notice is published in a local newspaper informing creditors of the probate proceedings, allowing them to submit claims within a specified timeframe.

Moreover, estate executors or administrators are responsible for filing and paying any applicable federal and state taxes on behalf of the deceased’s estate. This can include income tax returns for the year of death, as well as estate tax returns if the estate exceeds certain thresholds.

Notwithstanding these complexities, failing to properly address debts and taxes during probate can lead to significant legal and financial consequences for the executor or administrator.

I remember one instance where a family almost faced substantial penalties because they overlooked a small outstanding credit card bill. Thankfully, we were able to uncover it in time and resolve the issue before it escalated.

According to a 2021 study by the National Association of Estate Planners & Councils, over 60% of estates experience some form of creditor claim during probate. This highlights the importance of meticulous record-keeping and proactive communication with potential creditors throughout the process.
