Meet the Expert
Today, I’m sitting down with Steve Bliss, a well-respected estate planning attorney right here in Wildomar. Steve has been helping families navigate the complexities of estate planning for over a decade and is known for his compassionate approach and dedication to client satisfaction.
Selecting an Executor or Trustee: A Crucial Decision
Steve, let’s talk about choosing an executor or trustee. This seems like a pretty important step. What advice do you give your clients when they’re making this decision?
“Absolutely,” Steve begins. “Selecting the right person to manage your estate is paramount. It’s someone who will carry out your wishes faithfully and responsibly. Consequently, I always advise my clients to consider factors like trustworthiness, financial competence, organizational skills, and, most importantly, their willingness to take on this significant responsibility.”
He continues, “Notwithstanding these qualities, it’s also important to have open and honest conversations with potential executors or trustees. Discuss your expectations clearly and ensure they understand the scope of the role. Remember, it can be a time-consuming and emotionally demanding task.”
Steve explains that choosing someone who is familiar with your finances and family dynamics can be beneficial. Nevertheless, he cautions against automatically assuming the eldest child or closest relative is the best fit. “Sometimes,” he shares, “it might be more appropriate to select a trusted friend, financial advisor, or professional trustee.”
He elaborates, “Choosing an executor or trustee involves considering both personal and practical factors. It’s about finding someone who you trust implicitly and who has the capacity to fulfill this crucial role.”
Navigating Challenges: Learning from Experience
Steve, I imagine there have been times when selecting an executor hasn’t been straightforward. Can you share any experiences that highlight the importance of careful consideration in this step?
Steve nods thoughtfully. “There was one case where a client named their son as executor without fully discussing his financial situation. It turned out he was going through some significant personal challenges and wasn’t equipped to handle the estate responsibly. This led to delays, disputes among family members, and ultimately, increased costs.”
He pauses, then adds, “This experience reinforced the importance of open communication and thorough vetting when selecting an executor or trustee. It’s crucial to be realistic about their capabilities and have a backup plan in case circumstances change.”
Peace of Mind Through Proper Planning
Steve, what’s one key takeaway you hope readers gain from this conversation?
“Estate planning is often seen as something for later in life,” he says. “But the reality is that unexpected events can happen at any time. Having a well-crafted estate plan provides peace of mind knowing that your loved ones will be taken care of according to your wishes. According to a study by Caring.com, 60% of adults don’t have a will, leaving their assets subject to intestate succession laws which may not align with their desires.”
